The Chinese government performance permit was signed and issued on October 28th, 2009, while SM started selling the tickets for the performance in September after the provisional disposition was filed, which means they started selling the tickets before obtaining the Chinese government permit.
In the following picture are two permit. The first one is obtained on October 28th for the Shenzhen concert, it was then updated on November 3rd. The second half is the permit for the Bejing concert. For both, the dates the permits were attained have been underlined.
So basically, SM began selling the tickets before they were certain whether the concert will happen or not. Even though SM specifically said they knew about all the stops in June 2008 for the tour, there’s no way they could have been certain of this particular concert until October 28th of this year.

its soooo obvious that this concert is a trick ,,
i mean :
-it does not scheduled from the begging ,
-it confirmed after the lawsuit
-even dbsk members does not know about it at 1st
-the ticket was in sell before agreement
-finally,, its got canceled
& all this for two reason only :
1- blame JSC
2-get more money

Baidu said TVXQ were invited… also something about SM wont attend? so maybe they wont let TVXQ attend.
However, with the court decision, the 3 members could make their own choice whether to attend or not. So if they were invited, then they could attend if they choose t do so!

well the trio already said that their solo activities will push through regardless of what sm will say.
If they will not start now, when will they start? Its obvious sm will not give them solo jobs. Whats the use of them fighting for their freedom to do solo activities? I think its time to face the public.

They already attained their freedom to do solo activities. And the full lawsuit will last maybe less than a year. Do you want them not to do solo activities and just wait for sm? I thought the main reason why they filed the lawsuit is to have freedom in their careers. If they will constantly be wary of sm, then i guess their fight for freedom will just go under the drain.

Any talent agency’s primary task should be that of supporting good music and taking care of the “upbringing” of its artists.In reference to that point,
SM ent. is just a plain eyesore.Nothing more,nothing less.This stop in Shenzhen was fishy in the first place.Thus,this piece of news adds nothing to wot we already know.As far as MNET inviting TVXQ is concerned,they should definitely attend.I mean,they got nothing to hide or to be ashamed of.And this year SM announced they would boycott MAMA,so this could be a good chance for them to use their newly acquired independent decision making “power”.Nevertheless,the question is “will SM ent. prevent Homin from showing up?”.I fear so.

From my point of view, SME already gave us a hint about this back on Aug 09: [TRANS] 090821 SM “We’ve Lost 15 Billion Won+ In Image Damage Because Of This Trial”: “But in the case of SME, they had to pay compensation for said canceled events and future scheduled events with 8 billion Won to pay domestically and 15 billion Won to pay if overseas activities are calculated. That’s why I already questioned about this Shenzen concert since I got a feeling that it’s only a trick from SME to give more pressure to JCS.
I suggest as fans please becareful to not fall to SME’s trap. SME had cancelled SMTown Concert only few days before the D Day & now the same thing happen again. In the end, the fans become the victim.
FYI, SME already hold JCS income since Feb 09, JCS had fulfill their duties without get any fee. So, I will not blame JCS for their decision to not attend the Shenzen concert, since until now there is no good willing from SME about their payment.
I know you all really want to see them on the stage but please be patient until this dispute is clear.
